  1. Applicability
These general terms and conditions apply to every offer, quotation, and distance contract between Furnitly and the consumer, including customers in Belgium. Deviations are only valid if expressly and in writing confirmed by Furnitly. By placing an order, the customer accepts these conditions without reservation.

  2. Offer and Formation of Contract
All offers and promotions are non-binding and subject to availability.
Furnitly reserves the right to adjust prices, correct errors, and change product information.
A contract is only formed when Furnitly confirms the order by email or when shipment has occurred.
Furnitly reserves the right to refuse or cancel orders, even after confirmation, in case of errors, stock issues, or other commercial reasons.
Obvious typing, printing, or technical errors in prices, product descriptions, or images do not bind Furnitly.
Images are for illustration only and may slightly differ from the delivered product. Furnitly strives for accurate photos but small variations due to materials, lighting, or production may occur.

  3. Prices and Payment
All prices are in euros (€) including VAT.
Shipping costs and extra fees are clearly stated during the ordering process.
Prices may change at any time before the contract is formed.
Furnitly reserves the right to cancel orders in case of obvious pricing errors.
Payment must be made at the time of order via available payment methods.
Ownership of goods remains with Furnitly or its suppliers until full payment is received.

  4. Delivery and Execution
Furnitly delivers within the Netherlands and Belgium to the address provided by the customer.
Products may be shipped directly by suppliers or logistics partners of Furnitly.
Furnitly aims to fulfill orders within 30 days unless agreed otherwise. In case of delay, the customer is informed within 30 days and may cancel the contract free of charge.
The customer must provide correct and complete address information. Furnitly is not liable for delays, non-delivery, or extra costs due to incorrect address details.
Any extra shipping or return costs due to incorrect information are borne by the customer.
If the customer is not present at delivery, extra re-delivery or storage fees may be charged.
All delivery times are indicative; exceeding them does not entitle the customer to compensation.
Risk of damage or loss lies with Furnitly until delivery to the customer or designated representative.

  5. Early Order Cancellation
If the customer wants to cancel an order before shipment, Furnitly will try to accommodate. Cancellation is only valid after Furnitly’s confirmation. If the order is already handed to the carrier, the customer may use the right of withdrawal.

  6. Right of Withdrawal
Consumers have the right to cancel the contract within 14 calendar days after receiving goods without giving reasons.
The customer must notify clearly by email to [customerservice@furnitly.com] and return goods within 14 days at their own cost and risk.
Products must be unused, complete, and in original packaging.
The customer is liable for any diminished value caused by treatment beyond what is necessary to check the nature and function of the product.
Furnitly refunds the purchase price excluding original shipping costs within 14 days after receiving goods in good condition.
Exceptions: custom-made or personalized products; perishable goods or hygiene-related non-returnable products.

  7. Warranty and Complaints
Furnitly guarantees products comply with the contract, provided specifications, and reasonable consumer expectations (statutory warranty).
Visible defects must be reported immediately upon delivery; hidden defects within a reasonable time after discovery.
Complaints must be submitted in writing with clear descriptions.
Warranty voids if products are mishandled, externally damaged, or altered unauthorized.

  8. Liability
Furnitly’s liability for direct damage is limited to the amount paid by the customer for the relevant order.
Furnitly is not liable for indirect damage (consequential loss, lost profits) unless due to intent or gross negligence.

  9. Force Majeure
Furnitly is not obliged to fulfill obligations if prevented by circumstances beyond its control (war, natural disasters, strikes, etc.). If such circumstances last more than two months, both parties may terminate the contract without compensation.

  10. Retention of Title
All delivered goods remain property of Furnitly or its suppliers until the customer fully complies with all contractual obligations.

  11. Disputes and Applicable Law
Dutch law exclusively applies to all legal relationships with Furnitly.
All disputes are submitted to the competent court in the Netherlands unless mandatory law dictates otherwise.

  12. Other Provisions
If any provision of these terms is void or invalid, the remainder stays fully effective.
In case of conflict, these General Terms prevail.
Ambiguities in interpretation are resolved in favor of Furnitly as much as possible.
