Terms & Conditions

By shopping at Furnitly, you agree to the following terms and conditions. We aim to provide a transparent and respectful relationship with all our customers.

Furnitly V.O.F.
Registered office: François de Veyestraat 8B, 6221 AB Maastricht, Netherlands
Chamber of Commerce (KvK) number: 96879483
 VAT Identification Number (BTW): NL867812278B01

These Terms and Conditions apply to every offer, quotation, and distance contract concluded between Furnitly and the consumer, including customers located in Belgium. Deviations are only valid if explicitly confirmed in writing by Furnitly.

By placing an order, the customer accepts these Terms and Conditions without reservation.

All offers and promotions are non-binding and subject to availability. Furnitly reserves the right to adjust prices, correct errors, and modify product information at any time.

An agreement is concluded only once Furnitly has explicitly confirmed the order by email or upon shipment of the product. Furnitly reserves the right to cancel or refuse orders, even after confirmation, if necessary due to errors, stock issues, or other commercial reasons.

Obvious clerical errors, misprints, or technical errors in prices, product descriptions, or product images do not bind Furnitly. Product photos are intended for illustrative purposes only and may differ slightly from the actual delivered products. Furnitly strives to ensure that images match products as closely as possible, but cannot guarantee complete accuracy due to variations in materials, lighting, and production batches.

All prices are stated in Euros (€) and include VAT. Shipping costs and any other additional charges are clearly stated separately during the ordering process.

Prices may be changed at any time prior to a confirmed agreement due to supplier changes, currency fluctuations, material price increases, or legal changes. Furnitly has the right to cancel any orders in case of obvious errors.

Payment must be made at the time of ordering through the available payment methods. Ownership of goods remains with Furnitly or its suppliers until full payment is received.

Furnitly delivers in the Netherlands and Belgium to the delivery address provided by the customer. Products may be shipped directly from Furnitly’s suppliers or logistics partners.

Furnitly will take the greatest possible care when receiving and executing orders for products.

Furnitly will execute accepted orders with due speed but at the latest within 30 days, unless a longer delivery period has been agreed with the consumer. If delivery is delayed, or if an order cannot be executed or can only be executed in part, the consumer will be informed no later than 30 days after placing the order. In that case, the consumer has the right to terminate the agreement without costs. The consumer is not entitled to any additional compensation or damages beyond a full refund of any amounts already paid.

The customer is solely responsible for providing correct and complete delivery address information. Furnitly is not responsible for any delays, non-deliveries, or additional costs resulting from incorrect or incomplete address information provided by the customer. Additional shipping or return costs arising from such errors will be borne by the customer.

If the consumer is not present at the delivery address at the agreed time, the delivery service will either attempt a second delivery or deliver the package to a pickup point, depending on the carrier’s policy. Any additional costs incurred for repeated delivery attempts or storage will be charged to the customer.

All delivery times are indicative. The consumer cannot derive any rights from any delivery periods mentioned. Exceeding a delivery period does not entitle the consumer to compensation.

In the event of termination in accordance with this article, Furnitly will refund the amount paid by the consumer as soon as possible, but at the latest within 14 days after termination.

If delivery of an ordered product proves impossible, Furnitly will make every effort to provide a comparable replacement article. It will be clearly and comprehensibly stated upon delivery that a replacement article is being delivered. The right of withdrawal cannot be excluded for replacement articles.

The risk of damage and/or loss of products rests with Furnitly until the moment of delivery to the consumer or a previously designated representative made known to Furnitly, unless expressly agreed otherwise.

Early Cancellation of Orders

If a consumer wishes to cancel an order before it has been shipped, Furnitly will make reasonable efforts to accommodate the request. However, cancellation is not guaranteed until confirmed by Furnitly.

If the order has already been handed over to the carrier or supplier for delivery, the consumer must await delivery and may then exercise their right of withdrawal in accordance with Article 6 of these Terms and Conditions.

Consumers have the right to withdraw from the contract within 14 calendar days after receiving the goods, without providing a reason.

The customer must notify Furnitly via a clear statement (by email to customerservice@furnitly.com) and return the goods within 14 days at their own risk and expense. Products must be returned unused, complete, and in their original packaging.

Customers are liable for any depreciation in value resulting from handling beyond what is necessary to establish the nature and functioning of the products.

Furnitly will reimburse the purchase amount excluding standard shipping costs within 14 days of the withdrawal notice, provided the returned goods have been received in good condition.

Exceptions to the right of withdrawal include:

  • Products made to the consumer’s specifications or personalized.

  • Products that deteriorate rapidly or are not suitable for return for reasons of health protection or hygiene.

Furnitly guarantees that the products comply with the agreement, the specifications stated in the offer, reasonable usability, and existing statutory provisions.

Consumers are entitled to a legal warranty: the product must have the qualities that the consumer can reasonably expect, considering the nature of the product. This warranty is not limited in time to a fixed period and depends on the nature of the product.

Visible defects must be reported immediately upon delivery; hidden defects within a reasonable period after discovery. Complaints must be submitted in writing with a clear description.

Warranty claims are void if defects are the result of improper use, external causes, or unauthorized interventions.

If a manufacturer or supplier offers an additional commercial warranty, this does not limit the rights that consumers have under the law against Furnitly.

Furnitly’s liability for direct damages is limited to the amount paid by the customer for the respective order.

Furnitly is never liable for indirect damages, including but not limited to consequential damages, lost profits, missed savings, and business interruption.

The limitations of liability do not apply in cases of intentional misconduct or gross negligence.

Furnitly is not obliged to fulfill any obligation if hindered by circumstances beyond its control, including but not limited to war, natural disasters, pandemics, cyberattacks, strikes, transport disruptions, or government measures.

In case of force majeure lasting longer than two months, both Furnitly and the customer are entitled to dissolve the agreement without liability for damages.

All goods delivered remain the property of Furnitly or its suppliers until the customer has fulfilled all obligations under the agreement.

The customer may not resell, pledge, or otherwise encumber products subject to retention of title.

Dutch law exclusively governs all legal relationships with Furnitly.

All disputes arising from or related to these Terms and Conditions will be submitted to the competent court in the Netherlands, unless otherwise required by mandatory law.

If any provision of these Terms and Conditions is declared null or invalid, the remaining provisions will remain in full effect.

In case of a conflict between these Terms and Conditions and other contractual arrangements, these Terms and Conditions shall prevail unless explicitly agreed otherwise.

Situations not covered by these Terms and Conditions must be assessed in the spirit of these Terms and Conditions.

Uncertainties regarding the interpretation or content of one or more provisions will be interpreted as much as possible in favor of Furnitly.
